1. Introduction

These Terms and Conditions ("Terms") govern your use of this platform and its related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

The Service is designed for business use by professionals. If you act on behalf of a company or organization, you confirm that you have the authority to bind that entity to these Terms.

2. Description of Service

The Service is a SaaS platform that provides AI visibility analysis tools, including monitoring of brand presence in AI-generated search results, LLM responses, and related data analysis capabilities.

Results are generated through automated processes and third-party data sources. While we strive for accuracy, results depend on external data availability and may not be 100% accurate at all times.

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account Security

You must notify us immediately at info@blackboxanalyzer.com if you suspect unauthorized access to your account. You are responsible for all activities that occur under your account.

3.3 Account Accuracy

Providing false or misleading information may result in suspension or termination of your account.

3.4 Data Backup

You are responsible for maintaining your own backups of data. The Service is not a data backup service.

4. Subscription Plans and Payment

4.1 Plans

The Service is offered through subscription plans with varying features and limits. Details of available plans and pricing are displayed on the platform.

4.2 Billing

Subscriptions are billed at the beginning of each billing cycle. Payments are processed through a third-party payment processor.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4.4 Price Changes

We may adjust pricing with at least 30 days' notice. Price changes do not apply retroactively to already-paid periods.

4.5 Refunds

Fees are generally non-refundable. If we terminate your account without cause, we will provide a pro-rata refund for the unused portion of your subscription.

5. Credits

Some plans include usage credits that are consumed when using analysis tools. Credits are allocated per billing period, are non-transferable, and do not carry over to the next period. Unused credits expire without refund at the end of each billing cycle.

6. Third-Party Services

The Service integrates with third-party services to provide analysis results. We are not responsible for the availability, accuracy, or content of third-party services. Some plans may require you to provide your own API credentials for third-party data providers. You are responsible for complying with those services' terms.

7. Intellectual Property

7.1 Our Rights

The Service, including its source code, design, functionality, and documentation, is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription.

7.2 Your Data

You retain ownership of all data you submit to the Service. We do not claim ownership of your data.

8. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the Service
• Circumvent security measures or access restrictions
• Use the Service for any illegal purpose
• Resell, lease, or sublicense access to the Service
• Use automated tools to scrape or extract data beyond the Service's intended use
• Interfere with the Service's performance or availability
• Share account credentials with unauthorized third parties

We may monitor for violations and suspend or terminate accounts that breach these rules.

9. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, third-party outages, or events beyond our reasonable control.

10. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that analysis results will be accurate, complete, or current. Results are for informational purposes and should not be relied upon as the sole basis for business decisions.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Our total aggregate liability shall not exceed the total fees you have paid to us in the 12 months preceding the claim.

This limitation does not apply to liability arising from gross negligence, willful misconduct, or fraud.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

13.1 By You

You may terminate your account at any time by canceling your subscription and requesting account deletion through the Service.

13.2 By Us

• Immediately if you breach these Terms
• With 30 days' notice for any other reason, with a pro-rata refund for unused subscription time

13.3 Effect of Termination

Upon termination, your access to the Service ceases. You may request export of your data within 30 days of termination. After that period, we may delete your data.

14. Personal Data

We process personal data in accordance with our Privacy Policy and applicable data protection laws. If you process personal data through the Service, the Data Processing Agreement applies.

15. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.

16. Changes to These Terms

We may amend these Terms with at least 30 days' notice via email or platform notification. Continued use after the effective date constitutes acceptance. If you disagree with the changes, you may terminate your account and receive a pro-rata refund for any unused subscription period.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
